Be Prepared When You Decide to Consult with or Hire your Divorce Attorney

Keep in mind that most divorce attorneys charge by the hour.  Hourly rates vary depending on level of skill, experience and specialization.   In the Los Angeles County area, rates average $250 to $400 an hour for a skilled and experienced divorce attorney.  That's all the more reason why it's important to do as much of your own preparation work as possible. California law requires disclosure of your marital and separate assets and debts.  Be prepared to provide your lawyer with copies of all your financial and legal documents, including real property deeds, mortgage documents, tax returns, bank statements and documentation of your outstanding debt. By gathering and organizing the paperwork on your own, you can easily save several hundred dollars.  The more organized you are the less time your attorney or paralegal staff members will have to bill in compiling and preparing your mandatory disclosures. 

What is meant by irreconcilable differences?
Most California divorces proceed on the grounds of Irreconcilable Differences.  As California is a no fault divorce state, the exact details for the breakdown of the marriage are irrelevant, absent a few exceptions.  In short, once one partner has made a final decision that the marriage has broken down to an irreparable state, he or she can Petition to have the marriage dissolved and restored to the status of a single person.
